The lesser-known past of the actor Cuzin Toma, from “Las fierbinți” before he was convicted for driving after consuming cocaine

“The facts are not of public interest”, the DIICOT prosecutors reasoned for closing the files in which the actor Cuzin Toma from the “Las fierbinți” series was investigated for consumption and driving under the influence of narcotics. In the third criminal case, in which the actor was sentenced with a suspended sentence, the judges justified the punishment with the personal circumstances of the actor, but also that he did not commit an accident while driving under the influence of drugs.

On November 14, Cuzin Toma was sentenced to a year in prison with a suspended sentence after he was caught in 2018 driving with a suspended license and under the influence of drugs. He had consumed cocaine, but also other narcotics, according to the results indicated by the forensic doctors in the expertise submitted to the prosecutors, as Libertatea wrote the other day.

The judges gave him the mildest punishment, as the postponements are considered – which are recorded in the record if he does not relapse – reasoning that the actor, in addition to his sincere attitude, involvement in educational projects for young people in Romania, and lack of criminal record.

Cousin Toma has a clean record, but this after two other times, in 2017 and 2020, the magistrates closed the files in which the actor was investigated because he was caught three more times with drugs in the car.

Prosecutors of the Public Prosecutor’s Office attached to the 3rd District Court charged Cuzin Toma in the case in which he was convicted the other day even while he was being investigated by DIICOT.

Libertatea consulted the two files in which the actor was investigated for possession of drugs for personal consumption, respectively driving under the influence of narcotics. In both cases, the prosecutors ordered the classification solutions citing the same reason: “lack of public interest”. The solutions for waiving criminal prosecution have also been validated by the courts.

The first file

The first time, Cuzin Toma was caught with drugs in his car on September 27, 2016. The actor was driving his car, a Volkswagen, on Alexandru Moruzzi street in sector 3.

According to the toxicological analysis report submitted to the file, the actor tested positive for THC (cannabis no) and MDAM (ecstasy no).

In his car, the police found a plastic bag containing 2.30 grams of cannabis, as well as two 2 grinders, one metal and the other plastic, both of which showed traces of cannabis.

“The defendant Toma Cuzin had a sincere attitude, admitting the facts that were retained in his charge”, stated the prosecutors.

The actor was sent to be evaluated by the specialists of the National Anti-Drug Agency (ANA), in order to determine if he is at risk of relapsing with regard to drug consumption.

The anti-drug specialists concluded that “there is no need to include drug users in the assistance circuit”, and the prosecutors closed the case.

“Considering the honest attitude of the defendant, the lack of criminal antecedents, the manner of committing the acts, the small amount of dangerous drugs possessed and that for the crime committed the law provides for a punishment of less than 7 years, the prosecutor found that there is no public interest in the pursuit of him, for which he ordered the abandonment of the criminal prosecution”, it is stated in the solution of the DIICOT prosecutors.

The case was submitted to the Bucharest Court, which on November 16, 2017 confirmed the abandonment of the criminal prosecution, the court pointing out that there would be a “clear disproportion between the expenses that would be involved in conducting a criminal trial and the seriousness of the consequences”.

Second file, closed

Less than two months after the case was definitively closed, Cousin Toma was caught again with drugs in his car. It happened in January 2018 on Splaiul Unirii no. 39 from the Capital.

In the car, the police found a hand-made cigarette with a specific smell, which the actor declared to be marijuana intended for personal consumption. A new criminal case was opened against him.

While he was being investigated by DIICOT for the act in January, Cuzin Toma was detected again with drugs in his car in May 2018, on Unirii Boulevard in Bucharest. And this time the actor declared that the manufactured cigarette is marijuana intended for personal consumption.

Indicted for the two acts of possession of drugs for personal consumption, the DIICOT prosecutors closed this case as well, citing the lack of public interest in relation to the intended purpose and the concrete circumstances in which the crime was committed. The solution was confirmed by the Bucharest Court in January 2020.

The third criminal case

Cousin Toma was charged in the third criminal case after he was caught driving with a suspended license in May 2018, and then in November of the same year, he was detected again in traffic, this time also under the influence of drugs.

According to the toxicological analysis bulletin, in November 2018 Toma Cuzin tested positive for THC, THC-OH, MDMA and MDA and benzoylecgonine – cocaine metabolite.

Found guilty of two counts of driving with a suspended license and one offense of driving under the influence of narcotics, District Court 3 sentenced him, on November 14, to one year of suspended prison, postponing the application of the sentence for a two-year supervision period. “From the documents in the file, it does not appear that he was previously sanctioned for contravening the road traffic regime”, the court pointed out.

When determining the punishment, in addition to the personal circumstances of the actor, his involvement in educational projects, the laudatory characterizations of his colleagues and the lack of criminal antecedents, the judges found another reason to justify the mild punishment.

“The court also takes into account the fact that the defendant was stopped in traffic by the police for a routine check, as he was not involved in any traffic accident that would have caused the arrival of the police on the scene”, the judgment reads on November 14 by the District Court 3. The decision is not final.
