Meanwhile, Prime Minister Nicolae Ciuca also announced that he took note of the minister’s resignation.
DNA prosecutors accuse the minister of 5 offenses of abuse of office and instigation to allow unauthorized persons access to information that is not intended for publicity. Adrian Chesnoiu denied the accusations.
“I have NOT committed any act of a criminal or corrupt nature and I have always carried out my executive activity with integrity and dedication! Following the appearance in the public space of suspicions regarding my ministerial activity, I made the following decisions: I ask all deputies from all parties to vote for the lifting of parliamentary immunity, because I believe that we are all equal before the law and I want to have the opportunity to eliminate any potential suspicion! ”, wrote Adrian Chesnoiu shortly on Facebook.
At the same time, Chesnoiu announced that he is resigning from the position of Minister of Agriculture and that he is suspending himself from PSD.
The head of DNA, Crin Bologa, on Thursday asked the Chamber of Deputies to lift the immunity of a deputy, now a minister, accused of abuse of office for allegedly rigging a competition.
“Between February 9 and April 11, 2022, the Minister allegedly determined a subordinate person, at that time a member of several examination commissions, to provide a colleague (a trusted person of the Minister) with some of the subjects designed for the tests. writings that were to be held on the occasion of the organization of four competitions for the positions of: class I counselor, head of service, deputy executive director and executive director of some county directorates. The respective subjects would later reach four “approved” candidates, out of which, following the written and oral tests, only three passed the respective competitions ”, the DNA prosecutors transmitted.
According to the investigators, at the direct intervention of the minister, in the case of one of the candidates, the members of the commission would have had to promote him in the conditions in which he had not obtained an adequate score.
What are the steps to boost immunity
DNA demanded the lifting of the parliamentary immunity for the Minister of Agriculture Adrian Chesnoiu, but for this to happen, a series of procedures must be followed.
The President of the Chamber of Deputies, Marcel Ciolacu (PSD), receives a request from the General Prosecutor of the PÎCCJ, addressed to the Chamber of Deputies, so that it can request the criminal investigation of the minister. That request shall be brought “immediately” to the attention of the Permanent Bureau of the Chamber.
The Permanent Bureau of the Chamber of Deputies has the obligation to ask the Legal Commission to present, within 5 days, an estimate of the time needed to conduct the hearing of the deputy and to study the documents submitted by the Prosecutor General. On the basis of the preliminary assessment, the Permanent Bureau of the Chamber of Deputies will set a deadline for the submission of the report by the Legal Affairs Committee, which may not exceed 14 days. The hearing of the member of the Government who is a deputy is mandatory. The report of the Legal Commission is approved by secret ballot of the majority of the members present.
The report on the request for criminal investigation shall be presented and debated in the plenary of the Chamber of Deputies within 5 days at the most from its submission to the Permanent Bureau. The draft decision on the request for criminal prosecution, drawn up by the Committee on Legal Affairs, Discipline and Immunities, shall be adopted by a majority of the Members present. The vote is secret and is expressed by ballots. If the Chamber of Deputies is not in session, the President of the Chamber of Deputies shall convene an extraordinary session and shall take the necessary measures to comply with the time limits laid down in this Article.
If the Chamber of Deputies decides to request criminal prosecution, the President of the Chamber will communicate this to the Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice. The respective decision of the Chamber of Deputies will be sent to the President of Romania for the eventual suspension from office of the member of the Government whose criminal investigation has been requested.
If the Chamber of Deputies does not decide to request the criminal investigation, the President of the Chamber will communicate this to the Prosecutor General of the Prosecutor’s Office attached to the High Court of Cassation and Justice and the parliamentary procedure ends.
