Confirmed convictions: Will Canan Kaftancıoğlu go to prison?

Thus, the prison sentences of 4 years, 11 months and 20 days, which Kaftancıoğlu received for a total of three separate crimes, were confirmed.

It was reported that in addition to the prison sentence, a political ban was also issued against Kaftancıoğlu.


After the decision, CHP Chairman Kemal Kılıçdaroğlu issued an appeal yesterday, and all MPs and hundreds of citizens gathered in front of the CHP Provincial Presidency in Istanbul.

How will the court process work after Canan Kaftancıoğlu’s approval decision, will Kaftancıoğlu go to jail?

I don’t want to give false information, he was sentenced to five different crimes. His sentence for three crimes was confirmed; A total of 4 years, 8 months and 11 days for insulting the president, publicly insulting the government and insulting a public official due to duty is 1/2. Accordingly, the total period of time he will spend in prison is 2 years, 5 months and 25 days. A law came into effect on March 20, 2020, extending the probation period to three years for those who have not relapsed for crimes committed before that date. Repeated means not having committed a crime before. Canan Kaftancıoğlu has not committed any previous crime. The execution of his sentence falls below three years. Therefore, he will enter an open-air prison and be released with a suspended sentence.


How will the prison process work?

The decision will first go to the Istanbul Prosecutor General’s Office, which will send an invitation to Canan Kaftancıoğlu with the meaning of “need for the execution of the sentence, postponement”. He will grant a delay of one week, Canan Kaftancıoğlu will go to the prosecutor’s office within a week, the prosecutor’s office will send Kaftancıoğlu to the nearest women’s prison. With a law enacted during the pandemic period, the probation period was extended from two to three years. Since Kaftancıoğlu’s crimes were committed before March 20 and there were no repeats, he should be released on the same day.

How do you assess the prohibition of politics, what does it cover?

In the Local Government Act and the Parliamentary Elections Act, the penalty should not exceed one year. Since Kaftancıoğlu’s sentence is more than one year, the right to be a deputy and an administrator does not seem possible for a while, considering these laws. After a certain period of time, it is possible to recover these rights with a Satisfied Rights Refund.

Could the confirmation of Kaftancıoğlu’s conviction following the verdicts in the Gezi case be a sign of early elections?

The current government has long tried to get a message across to politics and civil society through the judiciary. The Gezi trial was a message he sent to civilian politics ahead of the elections. He tried to intimidate. Now she is sending a message to politicians via Canan Kaftancıoğlu, trying to intimidate. We understand this message well. It is a process that we will fight with more courage and solidarity.
